TRADE-IN TERMS

These trade-in terms (the “Trade-In Terms”) apply when you use the trade-in functionality available on www.marshall.com(opens in a new window) (the “Website”), that allows you to return eligible Marshall products in exchange for a discount voucher (“Trade-In”). When you submit a Trade-In request on the Website, an agreement is entered between you and Marshall Group AB, with Swedish organization number 556757-4610, Centralplan 15, 111 20 Stockholm, Sweden (“Marshall”, “we”, “us”).

1. USE OF THE TRADE-IN

1.1 The Trade-In is available to customers with a registered account on the Website, in the countries where the Trade-In functionality is made available. Availability may vary depending on your location.

1.2 To use the Trade-In, you must have the right to enter into an agreement in accordance with applicable law, for example be of legal age to enter into agreements in your country of residence and not be under legal guardianship.

2. ELIGIBLE PRODUCTS

The Trade-In applies to Marshall products indicated to be eligible for Trade-In on the Website (each a “Product”). Marshall determines which products are eligible for the Trade-In and may be subject to change over time.

2.1 To be eligible for a Trade-In, the Product must:

(i) power and function in accordance with its intended use;

(ii) be lawfully owned by you and free from third-party rights; and

(ii) not fall within any of the categories listed in section 2.2.

Minor signs of use that do not affect functionality (such as light scratches or surface wear) do not affect eligibility.

2.2. The following are not eligible for a Trade-In:

(i) products that do not correspond to the information provided by you when submitting your Trade-In request;

(ii) products that do not power on or cannot be used for their intended purpose;

(iii) products with defects or damage that otherwise impair the Product’s performance or safety;

(iv) products with significant physical damage, including but not limited to broken components, exposed internal parts or severe corrosion;

(v) products that have been modified, repaired or altered in a way that may affect safety, compliance or performance;

(vi) counterfeit products or products not manufactured by or for Marshall; or

(vii) stolen products or products where ownership cannot be verified.

3. TRADE-IN PROCESS

3.1. To use the Trade-In, you must submit a Trade-In request via your Marshall account on the Website and submit the requested information. A Trade-In request is not automatically accepted or approved upon submission of your request.

3.2. If your Trade-In request is accepted by Marshall for processing, you will receive shipping instructions and a return label from us. A Trade-In is only approved once the Product has been received and approved following inspection by Marshall.

3.3. You must ship the Product in accordance with the instructions provided by Marshall.

3.4. Following receipt of the Product, Marshall will inspect the Product to verify that it meets the requirements for eligible Products set out in these Trade-In Terms.

4. SHIPPING

4.1. You are responsible for removing any personal data from the Product before shipping it to Marshall. Marshall does not assume any responsibility for personal data remaining on the Product.

4.2. You are responsible for packaging the Product securely and appropriately to prevent damage during transport.

4.3. You must ship the Product within the timeframe specified by Marshall when the return label is issued. If you fail to do so, your Trade-In request may be cancelled by Marshall.

4.4. The risk of loss or damage to the Product remains with you until the Product has been received by Marshall.

5. INSPECTION

5.1. All Products are subject to inspection by Marshall to verify compliance with these Trade-In Terms, including authenticity, functionality and condition.

5.2. Marshall has the right to reject a Trade-In if:

(i) the Product does not meet the requirements set out in these Trade-In Terms;

(ii) the Product differs materially from the information provided by you; or

(iii) Marshall reasonably suspects fraud, misuse or breach of these Trade-In Terms.

5.3. If you believe a decision has been made in error, you may contact our customer support.

6. TRANSFER OF OWNERSHIP

6.1 Until the Trade-In has been approved by Marshall, ownership of the Product remains with you.

6.2. If the Trade-In is approved, ownership of the Product transfers to Marshall upon receipt of approval. Once ownership has transferred, you no longer have any rights to the Product and Marshall may, at its discretion, refurbish, recycle, dismantle or resell it.

7. DISCOUNT VOUCHER

7.1 If your Trade-In is approved, Marshall will issue a discount voucher for use on the Website, subject to the terms set out in these Trade-In Terms (“Voucher”). The Voucher require your activation before use.

7.2. The value of the Voucher, including any applicable discount, and the products to which it may be applied, will be specified to you before you submit your Trade-In request. The Voucher may only be used in accordance with the conditions specified on the Website.

7.3. The Voucher:

(i) has no cash value and cannot be exchanged for cash;

(ii) is non-refundable, personal and may not be transferred; and

(iii) is valid for one (1) year after you activate the Voucher.

7.4. The Voucher can be combined with other offers on the Website.

7.5. If you exercise your right of withdrawal and return in accordance with our Terms of Purchase (to be found here(opens in a new window)) for a product purchased using a Voucher, the refund will correspond to the amount paid and the Voucher will be reinstated. Marshall may require you to contact our customer support in order to facilitate reinstatement of the Voucher. For the avoidance of doubt, the reinstated Voucher will expire on the same date as the original Voucher. If the Voucher would expire within the applicable return period, its validity will be extended accordingly.

8. REJECTED TRADE-IN REQUESTS

8.1. If a Trade-In is rejected by Marshall in accordance with these Trade-In Terms, no Voucher will be issued.

8.2. If a Trade-In is rejected, you may request that the Product is returned to you at your cost. If you do not request return within ninety (90) days from notice of the rejection, you agree that ownership of the Product will transfer to Marshall, and that Marshall may recycle or dispose of the Product in accordance with applicable law.

8.3. If a rejected Product is returned to you, the return will be made at your cost. The risk of loss or damage to the Product transfers to you once the Product has been handed over to the carrier by Marshall.

9. MISUSE AND FRAUD

Marshall has the right to refuse a Trade-In request, cancel a Voucher, or suspend access to the Trade-In in case of suspected fraud, misuse or breach of these Trade-In Terms.

10. AVAILABILITY AND AMENDMENTS

10.1. Marshall has the right to modify, suspend or terminate the Trade-In functionality at any time.

10.2. Vouchers already issued will remain valid for their stated validity period, unless otherwise required by law.

10.3. Marshall has the right to amend these Trade-In Terms at any time. Changes will be stated in the latest published version of the Trade-In Terms on the Website. For the avoidance of doubt, the version of the Trade-In Terms accepted by you at the time of submitting your Trade-In request will apply to that request.
